ASHRAE 90.1-2004 is New National Standard

Tax Refund

Earlier this year, the Department of Energy announced that ASHRAE Standard 90.1-2004 is the new national reference code. That means all states must certify that their commercial building codes are at least as stringent as 90.1-2004. While twenty-four states already have compliant codes, the rest must catch up by December 30, 2010.

How does this help you? The EPAct Commercial Building Tax Deduction is based on ASHRAE 90.1-2001, so buildings qualifying for the more stringent standards can often qualify for an EPAct tax deduction; even though they were just meeting state codes. If built to ASHRAE 90.1-2004, the following facilities may be good candidates for an EPAct tax deduction:

  • Automotive Facilities
  • Exercise Centers
  • Gymnasiums
  • Health Care Clinics
  • Hospitals
  • Hotels
  • Manufacturing Facilities
  • Movie Theaters
  • Museums
  • Post Offices
  • Sports Arenas
